PROCEDURE: Auction Company shall endeavor to maximize the value of the real estate. The real estate will be offered in multiple tracts. Bids on any individual tract, combination of tracts, or the entirety may compete. There will be open bidding during the auction as determined by the Auctioneer. Conduct of the auction and increments of bidding are at the direction and discretion of the Auctioneer. All decisions of the Auctioneer are final.

BUYER’S PREMIUM: A 5% Buyer’s Premium will be added to the high bid to determine the contract sale price.

DOWN PAYMENT: A 10% down payment will be required from the successful bidder on the day of the auction with the balance due at closing. The down payment may be in the form of c ash, cashier’s check, personal check or corporate check. Bidding is not conditional upon financing. The down payment is non-refundable. Should a buyer default, the downpayment shall be divided as follows: 20% to William Wilson Auction Realty; 80% to the Seller. 

ACCEPTANCE OF BID PRICES: All successful bidders will be requried to enter into Purchase Agreements at the auction site immediately following the close of the auction. The real estate will sell at Absolute Auction, regardless of price.

TITLE AND DEED: Seller agrees to furnish an owner’s title insurance policy brought down to date showing good and merchantable title for the sale of the Real Estate, and agree to execute and deliver to purchaser(s) a sufficient Deed for sale of real estate.

CLOSING: The balance of the purchase price is due at closing, which will take place within 30 days of the presentation of insurable title. 

POSSESSION: Posession to the real estate shall be delivered to buyers at closing.

REAL ESTATE TAXES: The real estate taxes will be the responsibility of the Buyer beginning with the taxes due and payable in November 2020 and therafter. 

MINERALS: Seller will convey all mineral interests owned.

SURVEY: If a survey is deemed necessary to establish new legal descriptions, the costs of the survey shall be split 50/50 between seller and buyer.
