PROCEDURE: The real estate will be offered in one tract. There will be open bidding during the auction as determined by the Auctioneer. Conduct of the auction and increments of bidding are at the direction and discretion of the Auctioneer. All decisions of the Auctioneer are final.
DOWN PAYMENT: A 10% down payment will be required from the successful bidder on the day of the auction with the balance due at closing. The down payment may be in the form of cash, cashier’s check, personal check or corporate check. Bidding is not conditional upon financing. The down payment is non-refundable.
BUYER’S PREMIUM: A seven percent (7%) buyer’s premium will be added to the high bid to the determine the contract sales price
ACCEPTANCE OF BID PRICE: The successful bidder will be required to enter into a Purchase Agreement immediately following the close of the auction. The final bid price is subject to the Seller’s acceptance or rejection.
TITLE AND DEED: Seller agrees to furnish an owner’s title insurance policy brought down to date showing good and merchantable title for the sale of the Real Estate, and agrees to execute and deliver to Buyer a sufficient Deed for sale of real estate.
CLOSING: The balance of the purchase price is due at closing, which will take place within 30 days of the presentation of insurable title.
SURVEY: Property has already been surveyed and platted as “Peelman’s Corner minor subdivision”. A copy of said survey will be provided to prospective buyers.
MINERALS: Seller will convey no mineral interests with the property.
POSSESSION: Possession to the real estate shall be delivered to Buyer at closing.
REAL ESTATE TAXES: The real estate taxes will be the responsibility of the Buyer beginning with the taxes due and payable in May 2021 and thereafter.
